Általános szerződési feltételek

  1. A szerződés hatálya, a szerződő felek

Jelen szerződés létrejött egyrészről a beugro.com Kft., mint a Beugro.hu közösségi piactér üzemeltetője, mint elektronikus szolgáltatást nyújtó Üzemeltető (a továbbiakban: Beugro.com)

a háztartási vagy házkörüli alkalmi munka igénybevevőjét (továbbiakban Szolgáltatást Igénybevevő Felhasználó)

Szolgáltatást végző és Munka igénybevevője együttes megnevezése Felhasználó (továbbiakban Felhasználó). Felhasználónak minősül az a természetes személy, aki háztartási vagy alkalmi munka keresési célból a Szolgáltatást igénybe veszi, valamint az a természetes személy vagy jogi személy (illetve a névben eljáró természetes személy), aki munkakeresési célból a Szolgáltatást igénybe veszi

Kiskorú Felhasználók tevékenységéért törvényes képviselőjük vállal teljes felelősséget és áll helyt.
Az Általános Szerződési Feltételek (továbbiakban: ÁSZF) tartalmazzák a https://beugro.hu/ weboldalon üzemeltetett szolgáltatás használatára vonatkozó általános szerződési feltételeket. Jelen dokumentum kizárólag elektronikus formában, magyar nyelven készül. Felhasználó az ÁSZF elfogadásával kifejezetten elfogadja és magára nézve kötelezőnek ismeri el a jelen ÁSZF rendelkezéseit, valamint kifejezetten hozzájárul a személyes adati Adatkezelési Szabályzat szerinti kezeléséhez.
Felhasználó által megadott adatok valóságtartalmáért Felhasználó felel és áll helyt.

  1. Alapvető rendelkezések

2.1. A jelen ÁSZF-ben nem szabályozott kérdésekre, valamint jelen dokumentum értelmezésére a magyar jog az irányadó, különös tekintettel a Polgári Törvénykönyvről szóló 2013. évi V. törvény (továbbiakban: Ptk.) és az információs társadalommal összefüggő szolgáltatások egyes kérdéseiről szóló 2001. évi CVIII. törvény vonatkozó rendelkezéseire. A vonatkozó jogszabályok kötelező rendelkezései a felekre külön kikötés nélkül is irányadók.
2.2. Jelen ÁSZF 2016. 10. 28. naptól visszavonásig hatályos. Az ÁSZF módosításáról az Beugro.com a szolgáltatás weboldalán ad tájékoztatást.

  1. Beugro.hu, mint online piactér

3.1. Az Beugro.hu a https://beugro.hu internetes cím alatt bárki számára elérhető közösségi piacteret üzemeltet azzal a céllal, hogy a háztartási vagy házkörüli, alkalmi, idényjellegű, projekt és egyéb nem állandó jellegű munkát igénylő, beugro.hu-mal szerződésben álló ügyfeleket (továbbiakban: Felhasználó) összekösse az Beugro.com-mal szerződésben álló, de nem a Beugro.com alkalmazásában álló, háztartási vagy házkörüli szolgáltatást végzők (továbbiakban: Szolgáltatást végző) egyikével, aki háztartási vagy házkörüli szolgáltatást nyújt a Felhasználónak.
3.2. A Felhasználó tudomásul veszi, hogy a Szolgáltatás igénybe vétele során az Beugro.com nem végez szolgáltatást, azaz Beugro.com csak szolgáltatást közvetít, így nem tartozik felelősséggel a Szolgáltatást végző által végzett munkáért, esetleges károkozásért.
3.3. A Felhasználó tudomásul veszi, hogy a Szolgáltatást végzője nem az Beugro.com alkalmazottja, hanem a Felhasználók számára háztartási vagy házkörüli, alkalmi, projektszerű szolgáltatásokat kínáló független személy vagy vállalkozó, akinek vele szemben a vonatkozó jogszabályok kereti között a  Szolgáltatást igénybevevő Felhasználó és a Szolgáltatást végzők között a Beugro.com közvetítésével létrejött szerződés alapján állnak  fenn jogai kötelezettségei.

  1. Szolgáltatás igénybevételének technikai lépései

4.1. A Szolgáltatás nyújtása céljából az Beugro.com a Weboldalon a Szolgáltatást Végző Felhasználó és Szolgáltatást Igénybe Vevő Felhasználók részére regisztrációs felületet biztosít (továbbiakban: Regisztrációs felület), ahol a Szolgáltatást Igénybe Vevő Felhasználó a Szolgáltatást végzők közül ki tudja választani a számára legszimpatikusabbat, az adott munkára legmegfelelőbbet.
4.2. A Felhasználó a Regisztrációs felületen kiválasztja a referenciák, értékelések alapján az igényeinek megfelelő háztartási vagy házkörüli munka végzőjét.  A chat funkción keresztül leegyezteti vele az elvégzendő munka részleteit, a „MEGEGYEZTÜNK” gomb lenyomásával elfogadja a munka ellenértékeként felmerülő szolgáltatási díjat, (továbbiakban: Szolgáltatási díj, mely tartalmazza a Szolgáltatást végző díját és a rendszerhasználati díjat, mely 15%) ezzel a Szolgáltatást igénybe vevő Felhasználó és a Szolgáltatást végző között szerződés jön létre. A Felhasználó regisztrál és megadja adatait a független banki Szolgáltatást végzőnek (Barion), majd letétbe helyezi a szolgáltatás ellenértékét, ami egészen addig nem kerül kifizetésre, amíg a munka el nincs végezve.

  1. Fizetés

5.1. Szolgáltatás Igénybevevő Felhasználó/Szolgáltatást végző tudomásul veszi, hogy a fizetés kizárólag a Stripe rendszerén keresztül történhet. A fizetés a Stripe, független banki felületen keresztül a következőképpen történhet: akár bankkártyával a szokásos módon, akár a Stripe Walletba való pénzfeltöltéssel. Utóbbi ebben az esetben nincs szükség bankszámla nyitására.
Mindkét esetben a Stripe biztonságos fizetési rendszerén keresztül történik a pénzátutalás.
5.2.  A Felhasználó a szolgáltatás megrendelésének pillanatában megadja bankkártyájának adatait a Barion felületén.  A pénz addig a Barion felületén marad, amíg szolgáltatást a Szolgáltatást végző el nem végzi.  Abban a pillanatban, amint a Szolgáltatás elvégzésre került és a Felhasználó azt egy gombnyomással visszaigazolja a Beugro.com weboldalán, vagy ennek elmaradása esetén a Szolgáltatás elvégzését követően 24 óra múlva automatikusan a Stripe rendszer a rendszerhasználati  díj, (15%) levonása után a maradványösszeget azonnal Szolgáltatást végző Barion számlájára utalja.     Amennyiben Szolgáltatást Végző és Szolgáltatást Igénybe Vevő együttesen úgy nyilatkozik, hogy a munka nem lett elvégezve, akkor az összeget a rendszerhasználati díj levonása után Szolgáltatást Igénybe Vevőnek visszatéríti a rendszer.

Stripe Fizetés: jelenti a Szolgáltatásokhoz kapcsolódó valamennyi fizetés lebonyolításának Szolgáltatást végzőjét, mint harmadik fél Szolgáltatást végzőt. Valamennyi Tag részére vagy részéről történő fizetést kizárólag a Stripe kezel anélkül, hogy az Beugro.hu felé bármilyen banki adatot közölne vagy továbbítana. A Stripe a Tag által megadott banki adatokat ellenőrizheti a hatályos szabályzatoknak megfelelően. További információk a Stripe Fizetés rendszerről a https://www.stripe.com/Home/Regulations oldalon.

A Beugró piactéren használható bankkártyák:

  1. Kárfelelősség, panasz

6.1. A Szolgáltatást végző teljes körű felelősséget vállal mindennemű kárért, amelyet okoz a Felhasználónak.
6.2. A szerződés nem szerződésszerű teljesítésének számít, ha a Szolgáltatást végző az Beugro.com által közvetített Felhasználó személyes adatainak birtokában az Beugro.com kizárásával nyújt szolgáltatást az adott Felhasználó részére. A Szolgáltatást végző az Beugro.hu által közvetített Felhasználóval csak az Beugro.hu-n keresztül léphet kapcsolatba és tarthat fenn kapcsolatot. A szerződés nem szerződésszerű teljesítése esetén az alábbiak az irányadó rendelkezések:
6.2.1. Amennyiben bebizonyosodik, hogy Szolgáltatást végző és/vagy Felhasználó megkerülni szándékozik Beugro.hu-t, úgy a szerződés megszegője 100.000,-Ft kötbér megfizetését vállalja Beugro.com részére.
6.2.2. Az Beugro.hu a Szolgáltatást végzővel fennálló szerződést azonnali hatállyal felmondhatja.
6.3.4. Amennyiben Felhasználó a „Feladat elvégezve, elküldöm a pénzt” gomb megnyomása előtt azt jelzi, hogy nem volt elégedett az elvégzett munkával, akkor Szolgáltatást végző kijavítja az esetleges hiányosságokat.  Vitás helyzet esetén, amennyiben Felek egymás között nem tudnak megegyezni a Békéltető Testület közbenjárását kérik a vita lerendezésében, vagy a felek bírósághoz fordulhatnak.
Az online fogyasztói vitarendezés magyarországi kapcsolattartó pontja a Budapesti Békéltető Testület (bekeltet.hu).

  1. A Szolgáltatást végző kötelezettségei

7.1. A Megrendelésben megállapodottak szerint végzi el az igényelt szolgáltatást, elfogadható mértékű odafigyeléssel és szakértelemmel.
7.2. Megtesz minden szükséges óvintézkedést a Felhasználó tulajdonának elvesztése és/vagy sérülése ellen.
7.3. Az igényelt megrendelés alapján a Felek által kívánt végeredménynek a lehető leginkább megfelelő módon nyújtja a Szolgáltatást.
7.4.. A Szolgáltatás időtartamát hatékonyan használja ki a Megrendelésben szerepeltek elvégzéséhez.
7.5. A Szolgáltatás nyújtását követően a szolgáltatásról számlát bocsát ki a Felhasználó részére, amennyiben ezt jogszabály előírja.

  1. Igénybevevő Felhasználó kötelezettségei

8.1. Megtesz mindent annak érdekében, hogy a Szolgáltatást végző hatékonyan elvégezhesse az igényelt szolgáltatásokat a Megrendelésnek megfelelően.
8.2. Mindent megtesz annak érdekében, hogy biztonságos munkahelyet biztosítson a Szolgáltatást végző számára;
8.3. Igénybevevő Felhasználó szavatolja, hogy a felkínált munkalehetőség sem közvetlenül, sem közvetett módon nem ütközik jogszabályba, hatósági rendelkezésbe, nem tartalmaz jogsértő, valótlan, pontatlan vagy megtévesztő információt vagy adatot, nem sérti harmadik fél jogát, vagy jogos érdekeit, továbbá a munkalehetőség csak olyan valós feltételeket tartalmaz, vagy ígér, amelyet a munka felkínálója ténylegesen biztosít.

  1. Egyéb rendelkezések, kizárás, törlés a regisztráltak soraiból

Amennyiben Felhasználó Szolgáltatást végző helyszínre érkezéséről nem a kialkudott munkára kéri fel Szolgáltatást végzőt, vagy Felhasználó más nevében kérte a szolgáltatást, de azt nem jelezte Szolgáltatást végzőnek előzetesen, akkor megtagadhatja a munkát.  Amennyiben egy Szolgáltatást végzőről vagy akár a Felhasználóról 3-nál több egy csillagos értékelés születik, a Felhasználó a regisztráltak soraiból automatikusan törlésre kerül.  Sem Szolgáltatást végző, sem Felhasználó nem reklámozhatja tevékenységét a Beugró honlapján, semmilyen formában nem jelenítheti meg sem telefonszámát, sem honlapjának címét, sem egyéb elérhetőségét.
Beugro.hu-nak joga van a honlapján megjelenő szövegeket moderálni.  A Hozzászólások, felhasználói tartalmak (hirdetés) Szolgáltatást végző által történő utólagos formai és tartalmi szempontú korrekciója, mely az alábbi következményeket vonhatja maga után (együtt vagy külön-külön is): a törlést, a Felhasználó jogainak korlátozását, illetve a Felhasználó időszakos vagy végleges kizárását.

Fotókkal való visszaélés: Fotókkal való visszaélésnek minősül, ha Felhasználó a feltöltött fotókon a jelen ÁSZF-be, jogszabályba, vagy egyéb jó erkölcsbe ütköző és / vagy figyelemfelkeltő tartalmat közöl. A fenti esetben a Felhasználó, illetve a Szolgáltatást végző 100.000 Ft kötbér megfizetését vállalja Beugro.com felé.

Megjegyzéssel kapcsolatos visszaélés: A Feladatok részletezésében megjelenő, a megjegyzés rovatban szereplő, a jelen ÁSZF-be, jogszabályba, vagy egyéb, jó erkölcsbe ütköző és/vagy figyelemfelkeltő szöveg, amely az Beugro.hu kikerülésére vagy kijátszására alkalmas, melynek célja a rendszerhasználati díj meg nem fizetése.

A fentieken túl megjegyzéssel kapcsolatos visszaélésnek minősül, ha a Felhasználó, illetve a Szolgáltatást végző:

  • a regisztráció során olyan fotót tölt fel, melyből kiderülhet a telefonszáma vagy egyéb elérhetősége.
  • másik Felhasználót vagy Szolgáltatást végzőt jelöl meg
  • egyéb szolgáltatásokat reklámoz
  • saját linket tüntet fel
  • olyan tartalom közzététele:
  • amely alkalmas arra, hogy megbotránkozást keltsen
  • amely nem az feladatra vonatkozik
  • amely véleményformálásra szolgál a portáltól független közösségi és egyéb médiában.
  • amely vulgáris
  • amely szexuális tartalmú
  • amely politikai tartalmú

Amennyiben egy adott Feladat leírása esetében a beugro.com ilyen tevékenységet azonosít, úgy azt jogosult azonnal eltávolítani, melyről írásban értesíti a feladót, megjelölve az eltávolítás indokát.  Egy adott e-mail cím vagy telefonszám csak a Szolgáltatást végző vagy Megrendelő regisztrációs oldalán felvitt adatai között szerepelhet. A Feladott Feladatok szöveges részében (a megjegyzésben) csak a Feladott feladattal kapcsolatos információk szerepelhetnek. Telefonszám, e-mail cím, link nem kerülhet bele ebbe a szövegbe és a szöveg nem tartalmazhat valótlan vagy félrevezető információt az feladatról és a Megbízóról. A beugro.com fenntartja a jogot az ilyen tartalmak törlésére.

Jogsértő tartalom bejelentése esetén Beugro.com jogosult a Felhasználó publikus felületének azonnali zárolására, a jogsértő tartalom eltávolításáig. Beugro.com bejelentés esetén eleget tesz a 2001. évi CVIII. törvény az elektronikus kereskedelmi szolgáltatások, valamint az információs társadalommal összefüggő szolgáltatások egyes kérdéseiről szóló jogszabályban foglaltaknak. A kivizsgálás jogi költségeit, jogos bejelentés esetén a Beugro.com a jogsértőre terhelheti.

  1. Szerzői jogvédelem

Beugro.hu fenntartja magának a szerzői jogvédelemmel kapcsolatos összes jogot, mind a honlapon megtalálható koncepció, tartalom és képi elemek tekintetében.

  1. Záró rendelkezések

11.2. Jelen Megállapodás elválaszthatatlan részét képezi az Adatvédelmi szabályzat.
11.3. A Beugro.hu jogosult jelen Általános Szerződési Feltételeket egyoldalúan módosítani.

the person providing the service of household or casual work around the house (hereinafter referred to as the User providing the Service)

the user of the household or casual work around the house (hereinafter referred to as the User Requesting the Service)

The joint name of the service provider and the user of the Work is User (hereinafter User). A user is a natural person who uses the Service for the purpose of looking for domestic or casual work, as well as a natural person or legal person (or a natural person acting in their name) who uses the Service for the purpose of looking for work.

Their legal representative assumes full responsibility and liability for the activities of minor Users.
The General Terms and Conditions (hereinafter: GTC) contain the general terms and conditions for the use of the service operated on the https://beugro.hu/ website. This document is prepared exclusively in electronic form, in Hungarian. By accepting the General Terms and Conditions, the User expressly accepts and acknowledges that the provisions of these General Terms and Conditions are binding on him and expressly consents to the processing of his personal data in accordance with the Data Management Regulations.
The User is responsible and liable for the truthfulness of the data provided by the User.

Basic provisions
2.1. Questions not regulated in these GTC and the interpretation of this document are governed by Hungarian law, in particular Act V of 2013 on the Civil Code (hereinafter: Civil Code) and Act CVIII of 2001 on certain issues of services related to the information society. . the relevant provisions of the law. The mandatory provisions of the relevant legislation apply to the parties without special stipulations.
2.2. These GTC are effective from 28 October 2016 until withdrawn. Beugro.com provides information on the amendment of the General Terms and Conditions on the website of the service.

Beugro.hu as an online marketplace
3.1. Beugro.hu operates a community marketplace accessible to anyone under the internet address https://beugro.hu, with the aim of finding domestic or around-the-house, occasional, seasonal, project and other non-permanent work that is under contract with beugro.hu connect existing customers (hereinafter: User) with one of the household or household service providers (hereinafter: Service provider) who has a contract with Beugro.com, but is not employed by Beugro.com, and who provides household or household services to the User.
3.2. The User acknowledges that when using the Service, Beugro.com does not provide a service, i.e. Beugro.com only mediates a service, so it is not responsible for the work performed by the Service provider, or for possible damages.
3.3. The User acknowledges that the provider of the Service is not an employee of Beugro.com, but an independent person or entrepreneur offering household or around-the-house, occasional, project-like services to the Users, against whom the relevant legislation includes the User using the Service and the providers of the Service between, your rights and obligations exist based on the contract concluded through the mediation of Beugro.com.

Technical steps for using the service
4.1. In order to provide the Service, Beugro.com provides a registration interface on the Website for the User Performing the Service and Users Requiring the Service (hereinafter: Registration interface), where the User Requiring the Service can choose the one most suitable for the given job from among the Service Providers most appropriate.
4.2. On the Registration interface, the User selects the person performing the household or around-the-house work according to their needs, based on references and evaluations. Through the chat function, you agree with him the details of the work to be performed, by pressing the “AGREED” button, you accept the service fee arising as consideration for the work, (hereinafter: Service fee, which includes the fee of the Service provider and the system usage fee, which is 15%) and thus uses the Service a contract is created between the receiving User and the Service provider. The User registers and provides his data to the independent bank Service provider (Barion), then deposits the consideration for the service, which is not paid until the work is completed.

Payment
5.1. Knowledge of Service Requesting User/Service Provider

You understand that payment can only be made through the Stripe system. Payment can be made via Stripe, an independent banking interface, as follows: either by bank card in the usual way, or by uploading money to the Stripe Wallet. In the latter case, there is no need to open a bank account.
In both cases, the money is transferred via Stripe’s secure payment system.
5.2. The User enters his bank card details on the Barion interface at the moment of ordering the service. The money remains on the Barion interface until the service is performed by the Service provider. As soon as the Service has been completed and the User confirms it with the click of a button on the Beugro.com website, or if this is not done, 24 hours after the Service has been completed, the Stripe system will automatically pay the remaining amount after deducting the system usage fee (15%) It is transferred to the account of Barion, which provides the service. If the Service Provider and the Service Recipient jointly state that the work was not completed, the amount will be returned to the Service Recipient after deducting the system usage fee.

Stripe Payment: refers to the Service Provider for processing all payments related to the Services, as a third-party Service Provider. All payments to or from Members are handled exclusively by Stripe, without communicating or transmitting any bank data to Beugro.hu. Stripe can check the bank details provided by the Member in accordance with the regulations in force. More information about the Stripe Payment system at https://www.stripe.com/Home/Regulations.

Liability, complaint
6.1. The Service Provider assumes full responsibility for any damage caused to the User.
6.2. It is considered non-contractual performance of the contract if the Service provider, in possession of the User’s personal data mediated by Beugro.com, provides services to the User to the exclusion of Beugro.com. The Service Provider may contact and maintain contact with the User mediated by Beugro.hu only through Beugro.hu. In case of non-contractual performance of the contract, the following are the governing provisions:
6.2.1. If it is proven that the Service Provider and/or User intends to bypass Beugro.hu, the contract violator undertakes to pay a fine of HUF 100,000 to Beugro.com.
6.2.2. Beugro.hu may terminate the contract with the Service Provider with immediate effect.
6.3.4. If the User indicates before pressing the “Task completed, I will send the money” button that he was not satisfied with the work performed, the Service Provider will correct any deficiencies. In the event of a dispute, if the Parties cannot reach an agreement, the mediation of the Conciliation Board is requested to resolve the dispute, or the parties may go to court.
The point of contact for online consumer dispute resolution in Hungary is the Budapest Conciliation Board (bekeltet.hu).

Obligations of the Service provider
7.1. Performs the requested service as agreed in the Order, with an acceptable level of care and expertise.
7.2. Takes all necessary precautions against loss and/or damage to the User’s property.
7.3. On the basis of the requested order, it provides the Service in the most appropriate way to the end result desired by the Parties.
7.4.. You use the duration of the Service effectively to carry out what was included in the Order.
7.5. After providing the Service, an invoice for the service will be issued to the User, if this is required by law.

Obligations of the Claiming User
8.1. You will do everything you can to ensure that the Service Provider can efficiently perform the requested services in accordance with the Order.
8.2. You will do your best to provide a safe workplace for the Service provider;
8.3. The requesting User guarantees that the job opportunity offered does not directly or indirectly conflict with legislation or official regulations, does not contain illegal, untrue, inaccurate or misleading information or data, does not violate the rights or legitimate interests of third parties, and the job opportunity is only as real as contains conditions or promises that the job offeror actually delivers.

Other provisions, exclusion, deletion from the ranks of the registered
If the User does not ask the Service Provider for the agreed work upon his arrival at the Service Provider’s location, or if the User requested the service in a different name, but did not notify the Service Provider in advance, he may refuse the work. If it is about a Service provider or even the User

if more than 3 one-star ratings are given, the User will be automatically deleted from the list of registered users. Neither the Service Provider nor the User may advertise their activities on the Visitor’s website, nor may they display their phone number, website address, or other contact information in any form.
Beugro.hu has the right to moderate the texts appearing on its website. Post-correction of comments, user content (advertisement) by the service provider in terms of form and content, which may entail the following consequences (together or separately): deletion, limitation of the User’s rights, or temporary or permanent exclusion of the User .

Misuse of photos: It is considered misuse of photos if the User uses the uploaded photos to publish content that conflicts with these Terms and Conditions, legislation, or other good morals and/or attracts attention. In the above case, the User or the Service provider undertakes to pay a fine of HUF 100,000 to Beugro.com.

Comment-related abuse: Text appearing in the details of the Tasks, appearing in the comment section, which conflicts with these GTC, legislation, or other good morals and/or attention-grabbing text, which is suitable for evading or evading Beugro.hu, the purpose of which is to pay the system usage fee not his salary.

In addition to the above, it is considered abuse related to comments if the User or the Service provider:

indicates another User or Service provider
advertises other services
displays its own link
publish content that:

If beugro.com identifies such activity in the description of a given Task, it is entitled to immediately remove it, which it notifies the sender in writing, indicating the reason for the removal. In the text part of the Assigned Tasks (the comment) only information related to the Assigned Task may be included. In case of notification of infringing content, Beugro.com is entitled to immediately block the User’s public interface, until the infringing content is removed. In case of notification, Beugro.com complies with CVIII of 2001. Act to the provisions of the legislation on electronic commercial services and certain issues of services related to the information society. Beugro.com may charge the legal costs of the investigation to the infringer in case of legitimate notification.
